Limitation of Liability

Gelati Art canvas artwork are not toys and in no way should be played with by children. Gelati Art is not liable for any parts that come loose or are torn off any of the artwork. Gelati Art produces canvas art for decorating children's rooms with the utmost safety in mind, however, young children can easily choke on small objects and for this reason we provide a safety precaution on the packaging of all of our products with parts susceptible to tampering that states, 'this product is not suitable for children under 3 years.'

The contents of this website and the designs used in our canvas artwork are protected by copyright and are specific property of Gelati Art. You may not reproduce, copy, or transmit this site or any of its contents in any way without our prior permission. Removal or reproduction in any form is infringement of the copyright law. Goods and Services

Gelati Art warrants that all goods promoted for sale on this site are of satisfactory quality. We use quality materials, including poly cotton canvas and ultrachrome pigment ink. Whilst every care is taken to ensure descriptions, designs and colours are correct, product representations may vary from what you see on your computer monitor. Please note that there will always be slight colour variance between the image seen on screen and the final product as different monitors give different colour results. Also, when artwork has been hand-finished, the very nature of this work means that there will be slight variation between each artwork.

We reserve the right to (a) make any changes in the specification necessary to comply with any applicable legal requirements and (b) change the specification published on this website provided this does not materially affect the quality of the goods. In all other respects, and to the maximum extent permissable, Gelati Art makes no other warranties or promises about the goods, and any implied warranties are excluded.

Availability of Products

We endeavour to make the products available for purchase from the site at all times. From time to time, however, heavy demand, limited editions or other factors beyond our control may render the products temporarily or permanently unavailable. We will endeavour to notify customers if this will affect their orders in any way.

Prices

All prices are in Australian dollars and are exclusive of delivery charge. A charge of 10% GST (Goods and Services Tax) is included in the retail price shown.

International Orders

International orders are exempt from GST. However, orders that are sent outside Australia may incur additional charges due to import taxes and duties levied at the point of entry in the destination country. Gelati Art does not have any control over any additional charges which may occur and will not be responsible for paying or contributing to any charges which may occur due to this.

Orders

Online orders will be completed once check-out proceeds through the secure payment system. An automatic email confirmation of the order will be sent to your email address. A hardcopy of the tax invoice will be sent with the item when it is dispatched.

Gelati Art reserves the right to review and/or cancel orders containing information that cannot be verified.

Gelati Art reserves the right to refuse or cancel any order when (a) products are unavailable for any reason; (b) an order placed through this site has not been received by Gelati Art for any reason; (c) full payment for the order has not been received by Gelati Art from the customer; (d) an order placed through this site has or may have been involved in any fraudulent activity.

Whilst Gelati Art will use all reasonable endeavours to ensure that the online ordering facility on this site will be available, accurate and error free, Gelati Art will not be responsible or liable in any way for any interruption or discontinuance of any or all of the functionality of this site; including, without limitation, the online ordering facility.

Payment

Gelati Art accepts Visa and MasterCard credit cards. There is no surcharge for using a credit card to make a purchase unless you are a wholesaler in which case a 2% surcharge applies. The name and address provided in the billing details should match the information as they appear on the credit card holder's statement. If not, we cannot process the order.

If your credit card is declined during the order processing, you will be notifed by email and/or telephone within 24 hours. Your order will not be sent unless the credit card number or details entered are authorised.

For Australian customers, we also accept bank cheques, Australia Post money orders and EFT/direct deposit payments. No other forms of payment are accepted. Direct deposit and EFT payments must be received within 3 working days. Cheque and money order payments must be received within 7 working days. We reserve the right to cancel any orders where payment has not been received within the specified time.  

All international orders will undergo address and payment verification procedures and this may delay dispatch of your order. 

Full payment is required before any order can be despatched. Gelati Art does not offer credit facilities.

Cancellation

If you would like to cancel your order, you should notify us within 24 hours of placing your order.

Deliveries

Please add $9.95 to each item in your order for freight and handling. Delivery is via courier. Your order should arrive within 2-7 days of payment being received.  Your postage and handling charge will be added during checkout. Loss or damage is very rare. When damage does occur we will replace the order (subject to availability) at our expense. Please advise us by email online@gelatiart.com.au of the loss or damage and return the damaged item and its packaging to us with your receipt and contact details. Returned items must be sent via Registered Post to us.

International orders are sent via airmail and should arrive within 14 days of payment being received. 

Any times quoted for delivery are approximate only and Gelati Art will not be liable for any courier delays.

Deliveries will be made to the delivery address supplied by you at the time of ordering. Gelati Art does not deliver to PO boxes.

Returns

If you are not totally satisfied with your purchase, you may return your item to us within 7 days from the date you received the item for exchange with an item of the same value or a credit note. Gelati Art does not offer refunds. To return an item, you must first send an email to us at online@gelatiart.com.au with your order number, contact details and reason for the return. We will assist you with your exchange (subject to availability) or credit note. Following this, you will need to enclose your receipt and merchandise in a secure box and send it by registered post to us at:

Returns must be returned to us within 7 days.

Customers will be responsible for shipping and handling charges unless the return is due to a fault on our part e.g. we sent the wrong item to you.

Products must be returned in the same condition as when purchased with shrink wrap plastic intact. We will not accept returned items that have been opened, used, damaged, scratched, marked, soiled or misused in any way.

Protecting your personal and order information is a priority at Gelati Art. We want you to be able to order from gelatiart.com.au with total confidence. To ensure your security, this site uses encryption technology to protect your personal information during data transport. Personal and credit card information are transmitted through a secure server using a highly secure 128-bit encrypted environment - Secure  Sockets Layer (SSL) technology. This is industry standard technology that ensures all your transactions within this site are securely processed.

Gelati Art uses encryption software in an attempt to keep personal information submitted secure. However, we cannot guarantee that any messages transmitted over the Internet, including those that include credit card details, will not be corrupted or intercepted by a third party.

To process your order it is necessary to give us your credit card details, address and a contact number. Failure to provide full information may forfeit your order. If you are uncomfortable providing your credit card details online, you can fax or phone your order to us.
